I came to US in 1996 as a student and graduated in 1999. Since then I have switched jobs and I am currently with a Priority date of oct, 2006(EB2). Even within this employer first they filed under EB3 even though it could have been filed under EB2 (Not becasue they are bad - becasue the employer don't know much about immigration). After I requested the employer, they filed a new labor on Oct, 2006. So if the priority date is based on the years of experience, it will be nice for me. But the main issue that all of us are facing is VISA availabilty. If this can be taken care, all of the issues will be taken care

don't have the guts to take care of anything person to person. That will only go to show how right the right things you do are. All checks cashed June 8th. It was sent to Nebrasks. I hardy just could read the SRC letters in back of my check. Online image in not good. I guess it has gone to Texas sercice center.

(1) One can be self employed
(2) 1099 or w2 - kinda tricky - most people I talked to do w2 and any profits they get after they take their salary are bonuses
Self-employment is possible only on 1099. If you're on W2, you're *not* self-employed. Pls see IRS guidelines (links above)
(3) The job has to be legitimate - in the same or similar category - you must be doing duties that are similar in nature to your 140 petition
(4) What is meant by legitimate is - you must simply not be doing "nothing" - there must be income and you must be doing your duties.
That's *your* interpretation of "legitimate." If you're self-employed and looking for contracts, your business is "legitimate." Since there's no clear definition of that from USCIS, DOl, IRS, we can *assume* your self-employment in similar occupation is legitimate. way better condition than millions. And those millions have not lost hope
and faith. Yes, you do not have GC so I also do not have GC. I do not
have assets like what Bill Gates or Anil Ambani has. So now I get a good
reason to depress and feel hopeless. Should I start feeling depressed?
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

against all odds. Have confidence and faith in yourself. Stand up to

The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

Hello everyone
Wanted to let everyone know of my experience. I dont physically have my card, but there is an approval notice on the USCIS website.
Priority date October 20th 2005
I opened a service request on Monday August 16th. The person on the other end of the line was extremely polite and nice. I told him I had a speaking engagement in Canada (which is the truth) and that if my case was expedited, I would not have to apply for a visa. He given me a SR number and asked me to wait for 30 days which I was prepared to do. However my case status changed online on August 19th. I am unsure as to whether this was because of the service request or things would have taken this route anyway.

But again, looks like, July 3rd 9:03 received by R. Williams, is no more a MIA case.
By the way the receipt date is marked as Oct 10th. Service center is NSC.

No, it's not criticism - I'm in the same boat, and the posts where many of us claim to plan to return home/country of origin/somewhere else "IF blah doesn't happen... by blah (insert your time period of choice/tolerance here)" are of high interest to me. It'd be great to be able to compile a list of such posts with original post date, end of tolerance threshold, action taken (if any) after that... and see what we get. :) (Yes, that may be a futile exercise for individuals... but may be of interest to IV as an organization... )
My guess is those who want to move just wake up one fine day, decide they've had enough of it, and follow it up with action (like book tickets, find a job back home, etc... ).

2) Being ready to go back. After all, the country where i was born and spent the first 25 yrs of my life cannot be that impossible for me to live in.

even if the law was interpreted incorrectly by the lawyer ...I wonder if they can do a admin fix ??? this is definitely beneficial for many people ..for e.g. those who are homeowners, etc etc ...atleast the primary spouse can change fields etc etc
