I agree. If "vertical spillover" occurs again, the only benefit would go to EB3-ROW.

It is very very difficult to convince anyone to overflow EB2 ROW -> EB3 ROW -> EB3 I (leaving EB2 I out of loop). (eventhough USCIS did it in past)

If someone tries to re-interprete, it will end up like:EB2 ROW -> EB3 ROW -> EB2I -> EB3 I, still no real benefit to EB3 I; only EB2 I will loose with some benefit to EB3 ROW.

Bottom line is, we need more visa numbers and that's what we need to campaign for. May it be recapture, or STEM exemption or anything else.

I am not saying this just because I am EB2, but these are the facts. Additionally, there is a big chance of new immigration law as soon as new president comes (likely some form of CIR) and we need to be prepared to have our agenda included in that; rather than splitting ourselves.


Earlier it was like this:

EB2 ROW --> EB3 ROW

If any left over after that then remaining numbers were equally divided between EB2-I/C and EB3-I/C so both EB2-I and EB3-I were getting equal share of spillover. Thats the way it should be.

This may sound optimistic and promising, but in essence sending random rhetoric using off message statements like "Erase Backlog Now" conflicts with our targeted messaging. To the observer on the Hill (i.e. in Congress) it all sounds more like a noise without a coherent message.

I'm sure you would agree that "no harm in trying" and "Leave no stone unturned" doesn't mean diluting our effort or sending incoherent message. That is why we need to have a single voice sending the same targeted message each time, otherwise we will just sound like awkward noise.

Can't agree less. We all have one goal. We are all one voice. In my personal opinion, I always try and stay optimistic.

What are the tax implications for Aman or other recieving this. We dont want uncle sam to take a cut from something like this. Is there any CPA who can throw some light on this?

Maybe this money can be used to create an expense account which can reimburse Aman and others for their expenses. We got to convince the Core to let democracy in IV work one time to create this account.

what the heck is happening to this stupid organization. did some one fart in the brains of the USCIS and DHS leadership. All I am saying is dont you idiots understand that the constant stress and pressure being faced by us with these dates going back and forth. keep them constant at a particular date, finish processing them and then move them one day at a time. then we will know when we will get the green cards. why move foraward give some one from 2006 green card and then push it to 2000 (who the f**k does not know that there is no one there in 2000).

anyway good luck and good waiting time for the next one month. man i was so eagerly waiting to see this bulletin. f**k these a**holes

Thanks sledge for your support.. That's exactly what I meant. One should at least have a job before applying for H1. I am in totally favor of H4 visa holders to be able to work. There are so many highly educated and talented people out there who are stuck at home or school because of H4 work permit law.

I wish good luck to all H4 visa holders and other people who are stuck in this immigration system.

The problem with him and many others including me is people like the OP, and in case you are also one of them, then we all have a problem with people like YOU!!!!!

He never claimed his wife was better than the OP. All he is saying is that his wife HAD a job, which is the minimum requirement to apply for an H-1B. He never said that converting from H4 to H1 is illegal!

Your coment that everyone is trying to improve their life is so simplistic and moronic. No one is denying you or the OP theright to improve one's life. Do so ethically!

How can you simply assume that everyone here came to the US through some bodyshopping company? How did you get your job? Was it through a consulting/bodyshopping company?

My 140 is filed at NSC. RD is on 05/25/2007. 485 is reached NSC on July 27. Filed from Texas. What are the chances of getting transferred to TSC. Need EAD for wife as soon as possible.
